About the Governing Documents

The following is an overview of our Governing Documents. It is incumbent upon every owner to comply with the governing documents (Declaration, By-Laws, and Rules) of the Imperial Plaza Condominium Association.

Declaration of Condominium
  • This document describes the rights and obligations of each owner and those of the Association itself. The Declaration outlines the boundaries of each unit and those of the common area. It describes the maintenance responsibilities of each owner and those assumed by the Association, the operating costs to the owners and how they will be collected and the rights and protections granted to mortgage holders.
  • Additionally the Declaration lays out the Association's powers of enforcement, procedures to resolve disputes and the restrictions on owner usage, which includes for example, how an owner alters their property and the uses of the common area.

Articles of Incorporation
  • Exhibit E - Declaration of Condominium: This document creates the Association as a legal entity (Corporation) within the State of Idaho, and is a necessary prelude to all the other steps when forming an incorporated homeowners' association.

By-Laws
  • Exhibit F - Declaration of Condominium: The By-Laws, not to be confused with the Declaration, describe the procedures and mechanics of the Association's management and decision-making. These include officer and director positions and how they are filled, the way meeting, voting and notification are undertaken for owners' and board members' decisions and the methods of record-keeping and reporting.

Rules
  • Rules preserve the benefits of living in the building for the all owners and residents. They cover things such as restrictions on how a unit may be altered, pets, waste disposal and the use of signage, parking and noise restrictions.
